Terms and Conditions You must agree to the terms and conditions below before checking out. Sharon W. Giles Realty, Inc. is a licensed real estate brokerage in the state of Georgia. It is acting as a flat-fee limited service company. It does not provide the same services as a "traditional" brokerage. Correspondingly, you are paying a reduced flat fee rather than the more common percentage fee typically charged by full-service brokerages. Using the services of Sharon W. Giles Realty, Inc.. does not create any agency or other relationship between you and Sharon W. Giles Realty, Inc. Sharon W. Giles Realty, Inc. does not owe you any fiduciary or other duty. Sharon W. Giles Realty, Inc. does not actually represent you. After Sharon W. Giles, Realty, Inc. submits the property to Multiple Listing Service, or any comparable multiple real estate listing service, the Order shall be deemed earned by Sharon W. Giles, Realty, Inc. shall be NONREFUNDABLE, and the undersigned shall not receive a refund of any funds paid for the Order. The Official Code of Georgia Section 43-40-1 (5.1) defines "Ministerial acts" means those acts related to real estate brokerage activities which a licensee or a licensee's employee performs and which do not require discretion or the exercise of the licensee's own judgment. The Official Code of Georgia Section 10-6A-3 (12) defines "Ministerial acts" means those acts described in Code Section 10-6A-14 and such other acts which do not require the exercise of the broker's or the broker's affiliated licensee's professional judgment or skill. The Official Code of Georgia Section 10-6A-3 (14) defines "Transaction broker" means a broker who has not entered into a client relationship with any of the parties to a particular real estate transaction and who performs only ministerial acts on behalf of one or more of the parties, but who is paid valuable consideration by one or more parties to the transaction pursuant to a verbal or written agreement for performing brokerage services. Sharon W. Giles, Realty, Inc. will provide such Ministerial Acts as stated in the service list of the particular product you purchase. Such acts may include one or more of the following: submitting the information you provide to the multiple listing service directory; providing you with pre-printed forms; providing you with names of local lender, inspectors, attorneys, insurance agents, surveyors, schools, shopping facilities, places of worship, and such other like or similar services. None of the Ministerial Acts performed by Sharon W. Giles, Realty, Inc. shall be constructed in such a manner as to form a brokerage engagement with you. Sharon W. Giles, Realty, Inc. does not provide assistance in any manner that would require it or its principles to exercise discretion or judgment. Examples of services that are not provided include: suggesting a sales price; negotiating with property. There have been isolated instances of reported burglaries of homes on which lockboxes have been placed and for which the lockbox has been alleged to have been used to access the home. In order to minimize the risk of misuse of the lockbox Sharon W. Giles, Realty, Inc. recommends against the use of lockboxes on door handles that can be unscrewed from the outside or on other parts of the home from which the lockbox can be easily removed. Since others will have access to your property you should remove all valuables or put them in a secure place. Sharon W. Giles, Realty, Inc. works to maintain its web site and services, but is not responsible for defects that may exist within its web site or any resulting loss of profits or other damages. Sharon W. Giles, Realty, Inc. attempts to accurately enter the information you provide into the multiple listing service. However, Sharon W. Giles, Realty, Inc. does not guarantee error-free service. If you discover any error you must promptly notify Sharon W. Giles, Realty, Inc. so the error can be remedied. Sharon W. Giles, Realty, Inc. is not responsible for any loss or damage suffered by the error. Sharon W. Giles, Realty, Inc. Sharon W. Giles, Realty, Inc. is a Georgia Corporation and its services are intended for use only by persons owning property located in Georgia. Georgia Real Estate Commission has determined that homeowners, unless licensed by the company listed on the real estate sign, may not advertise their name and phone number on the yard sign. Georgia Real Estate Commission?s interpretation of the Georgia law is that this is practicing real estate without a license. If a yard sign is damaged, the Seller agrees to pay a $50.00 yard sign shipping and handling fee. Seller hereby releases Sharon W. Giles, Realty, Inc. and those working through Sharon W. Giles, Realty, Inc. from all liability and responsibility in connection with any loss that may occur. You are responsible for complying with any subdivision, city, county, and state requirements in regards to signage laws, ordinances or restrictions. Should you be guilty of violating any laws, restrictions or ordinances, any resulting citations, fines or levees will be your responsibility. Seller agrees to submit an executed contract to Sharon W. Giles, Realty, Inc. within 48 hours after both parties have signed, and a settlement statement prior to closing, so Sharon W. Giles, Realty, Inc. , Inc. can update the MLS. The failure to do so will result in a fine to Sharon W. Giles, Realty, Inc. by the MLS, which will be charged directly to the seller. There is a $ 25.00 GaMLS and a $ 25.00 F.M.L.S fee to terminate or withdraw your home?s listing from GaMLS or F.M.L.S. prior to its expiration date. * **If applicable, there is an F.M.L.S. 0.12% service fee that will be charged at closing. ***When a property is listed by a Principal Member and a contract presented within ninety (90) days after expiration is accepted, providing the purchaser was introduced to the property prior to its expiration, a fee shall be due FMLS from the selling and listing Principal Member as described above when the property closes.
